Successful Defense of Independent Contractor Status Audit
Our employment law attorneys represented an insurance business in connection with a New York State Department of Labor audit. The purpose of the audit was to review the appropriateness of the client's independent contractor classification for its outside salespersons. After submitting our legal and factual arguments, the Department agreed that the workers were indeed bona fide independent contractors. Had we been unsuccessful in our efforts, our client would have had to change its business model, file various tax returns, and pay significant fines, penalties, and back taxes.
